MCA DoLS FAQ
The Mental Capacity Act (MCA) is designed to empower and protect individuals who may lack the mental capacity to make decisions on their own about their care or treatment. It is a law that was passed in 2005 and applies to people aged 16 and over. It applies to care homes and hospitals, care providers, the local authority and is in place to support people who may be at risk.
A lack of mental capacity could be due to:
1) a stroke or brain injury
2) a learning disability
3) a mental health problem
4) an illness such as dementia
5) confusion, drowsiness or unconsciousness because of an illness or treatment associated with it
6) substance or alcohol misuse.
According to the Mental Capacity Act an individuals liberty can only be taken away by health professionals if they use a set of procedures known as the Deprivation of Liberty Safeguards (DoLS), or if the Court of Protection has granted permission. Details regarding this are discussed in full on our MCA/DoLS E-Learning Course listed below.
There is no standard time length for a Deprivation of Liberty to be authorised (dols authorisation), as each authorisation is decided on a case by case basis. As the supervisory body, the managing authority follows a code of practice that decides when an individual is free to leave. The maximum length an authorisation can be granted is for 12 months. However once it has been issued, it can be reviewed at any time.

Do courses expire?
There is no expiry date on course credits. Once a credit has been bought it can be allocated at any time. However, should the credit have been allocated to the delegate, each learner then has 12 months to complete the course.
In other words, unallocated course credits have no expiry date. If for example you ordered 1000 licences, and allocated 600 courses in year 1, you would have 400 licences left to allocate in year 2.
